  • Recently, controversy surrounded Tamil Nadu after a case came up in Madras High Court pointing out that around 47,000 acres of temple land went missing from records of state.
  • In 2018, a temple pond spread over 2.68 acres disappeared and it was claimed that the pond land was transferred to a private party by one of the former trustees.
  • Recently, property valued at Rs. 160 crores that was linked to a temple was returned to it following a court order.
  • Recently, National Commission of Minorities claimed that there are around 3,000 properties in Telangana alone, which, if freed from encroachments, have the potential to generate ₹5 lakh crore, he said.
  • Hon’ble Prime Minister Sh. Narendra Modi has publicly declared it to be his dream that waqf lands be free of land grabbing and encroachments.
  • Recently, Hon’ble Madras High Court directed state government to conduct an inquiry into allegations of corruption and misappropriation of funds in Waqf societies across the state wherein officials have alienated properties worth Rs. 2,000 crore belonging to the Wakf.

The Root Problem

The core existence of religious and other charitable endowments is to spread societal good and to serve general public utility. But the endowments are also required to operate within a legal framework and at often times, the endowments lack access to quality legal advisory. Also, at often times, such endowments find themselves caught in an unwarranted web of lies and controversie.

Many times, encounter spiritual leaders who want to leave behind a legacy for future generations of society require handholding but are unaware of worldly and legal hurdles and the spiritual leader is unable to execute legacy.

For e.g., recently we were blessed to meet an aged Naga Sadhu who wanted to formalize the management of his organization, property of the organization, the gaushalas, etc. Unfortunately, the Naga Sadhu left for heavenly abode and thereafter, major fights and quarrels erupted among internal members of the unformalized organization and the properties came to be encroached and appropriated by such members. Thus, the welfare purpose of the Naga Sadhu came to be defeat
